Introduction

The Price case (formerly known as the Miles case) was a class action suit filed against Philip Morris USA Inc. in Madison County, Illinois.  The plaintiffs alleged that Philip Morris USA had defrauded "Lights" smokers by suggesting to them Marlboro Lights and Cambridge Lights were actually less hazardous than their full-flavor brands.

On December 15, 2005, the Illinois Supreme Court reversed the trial court’s judgment, which had assessed compensatory and punitive damages totaling $10.1 billion against Philip Morris USA. On May 5, 2006, the Illinois Supreme Court denied plaintiffs' motion for rehearing.  The United States Supreme Court denied plaintiffs' petition for certiorari on November 27, 2006.  On December 18, 2006, the trial court entered judgment in favor of Philip Morris USA and dismissed the case.
