Altria’s tobacco companies oppose legislation that would prohibit certain types of retail stores from selling tobacco products or would ban certain kinds of tobacco products.
Such legislation deprives businesses of the opportunity to sell a legal product, unfairly shifts business away from some retailers to others — with no public policy benefit — and imposes an unnecessary inconvenience on adult consumers.
Legitimate retailers should not be deprived of the opportunity to sell a legal product, as long as the retailer complies with all applicable laws and regulations. All retailers who choose to sell tobacco products should do so in a responsible manner and should sell them only to adult consumers. However, the business decision about whether to sell tobacco products should be left to the retailer.
Prohibiting certain kinds of retailers, such as those that contain a pharmacy, from selling tobacco products is unreasonable and drives consumers from these retailers to others not affected by the legislation. This results in the retailer losing tobacco product sales and sales of other products adult consumers typically purchase when visiting a retail store. This represents an unfair impediment to competition among retail stores that hurts some retailers and benefits others.
Banning tobacco products from certain retail stores or banning certain kinds of tobacco products can be inconvenient to adult consumers, forcing them to shift their purchasing behavior.
Altria’s tobacco operating companies strongly support reasonable laws and regulations intended to promote the responsible sale of tobacco products only to adults. These measures include laws that enforce minimum age requirements and that place tobacco products behind the counter to prevent self-service.
The vast majority of retailers sell tobacco products responsibly. Altria’s tobacco operating companies support retailers’ ability to continue to responsibly sell legal tobacco products.
